I am just now reading this post again, as I am about to leave for the L&amp;S Ass&#039;n conference in Baltimore, where I will discuss my good faith position.

Your post is actually even more thought-provoking on the second read, now that I have been away from the post for a while.  Your negligence/bad-faith point and reference to the Kitty Genovese case is. . . compelling.

I will think about this on the three-hour drive to Baltimore.  I thank you for giving me more things to consider as I prepare my comments.  Action versus behavior... the moral aspect of inaction...the road you go down toward aligning negligence with bad faith....  All very thought-provoking points.  Good for you, and thank you for working through all of this with me.</description>
